A comprehensive and authoritative guide....

The Localism Act 2011 has substantially altered the landscape somewhat concerning the provision of social housing allocations and the continuing problems of serious homelessness. The authors of this 3rd edition and both barristers at Garden Court Chambers, Jan Luba QC and Liz Davies, have met the challenge magnificently with this new edition of their work and it is a most welcome addition to the chambers library. Do read their `Stop Press' at the beginning of the book which sets out the timetable for the 2011 Act which was written in November 2012.
The book now reviews the following statutory responsibilities: the new power to discharge housing duties by offering private rented accommodation; the new two year rule for re-applying for homelessness assistance; the new power to exclude classes of people from allocation schemes; and the new rules affecting tenant transfers in social housing.
Luba and Davies say that what drove them to continue with this new edition was the experiences they had from across the country, of continuing interest and enthusiasm among local authority staff, housing association officers, housing lawyers and housing advice workers who want `to do the right thing' where possible- and we have found this to be the case on housing committees and in housing law itself.
The point of all this is that these people can ensure that the homeless, and applicants for social housing, may achieve minimum rights which the statutes have given them. The authors say "if our writing helps them in that endeavor, in any way, it will have been worth it". They have and it does!
The authors make one comment about the impact of fewer court decisions than in their previous editions. They make the point that this downturn (which some welcome because of the huge amount of case law available!) is a consequence of the greatly reduced availability of legal resources now on offer. It is not just a question of settlement of claims but also the diminishing number of specialist lawyers assisting the homeless because of legal aid reductions which has become a fact of life with the deficit reduction policies of the coalition government.
As a result the third edition looks at the role of the respective ombudsmen with greater emphasis identifying the lessons which have been learned from their investigations and reports produced. This could be the road ahead for some years and may well serve the claimants well as courts are so often the final resort, and not (as with some previous governments) the first resort for those seeking help.
This is a first class book from Jordans which is reader friendly for those new to the subject and it has a most useful CD ROM to assist for those readers who use discs. There are 4 appendices and the final one is a further stop press on recent developments which practitioners will find most helpful. The law is as quoted in November 2012.
